TOURIST PASMO使用條款

Chapter 1 General Rules
(Purpose)
Article 1
These rules set forth service contents and conditions for the use of IC cards, etc., with embedded IC chips that can record a monetary value (hereinafter, “TOURIST PASMO”) which are issued by PASMO Co., Ltd. (hereinafter, “the Company”) and made available for Foreign Visitors to Japan (as defined in Item 6 of Article3) for the purpose of enhancing user convenience and facilitating proper use of the product.
(Scope of Applicability)
Article 2
Notwithstanding the provisions of the Rules for Using PASMO, handling of TOURIST PASMO shall be governed by these rules as well as the provisions stipulated in the following items.
- (1) Transportation and other use by passengers using TOURIST PASMO shall be governed by the provision of IC card ticket handling rules for IC Card Handling Businesses as stipulated in Article 3, Paragraph 1, Item 1.
- (2) The PASMO Electronic Money Handling Rules shall apply mutatis mutandis to use related to the purchase of goods and services (hereinafter, “Electronic Payment”) at PASMO Member Stores set forth in Article 3, Paragraph 1, Item 5. In such instances, the term “PASMO” in the description of Items 1 and 2 of Article 3, paragraph 1 of the PASMO Electronic Money Handling Rules shall include the meaning of “TOURIST PASMO.”
- At such time as these Rules are revised, the use of TOURIST PASMO will be governed by the revised Rules.
- The Company may make substantial changes to these rules. In case revisions are made, the Company will post the timing and details of the revisions on our website in advance.
- Matters not stipulated in these Rules shall be governed by applicable laws and regulations.
(Meaning of Terms)
Article 3
Meanings of main terms used in these Rules are as explained in the items below.
- (1) “IC Card Handling Business” is a collective term for companies that are admitted by the Company to handle TOURIST PASMO.
- (2) “Child TOURIST PASMO” means a TOURIST PASMO issued according to the procedure described in Article 11, paragraph 2, which can only be used by the child for whom it is issued.
- (3) “Value” refers to the monetary value that is recorded on a TOURIST PASMO for use in paying for passenger fares and buying tickets, etc., specified by IC Card Handling Businesses set forth in Item 1, etc., or for paying for goods as services when TOURIST PASMO is used for Electronic Payment at PASMO Member Stores set forth in Item 5.
- (4) "Top up" means to add value to TOURIST PASMO.
- (5) “PASMO Member Store” means a member store specified in the PASMO Electronic Money Handling Rules.
- (6) “Foreign Visitors to Japan” means a person who wish to purchase TOURIST PASMO including foreign tourists visiting Japan.
- (7) “Group Companies” means a parent company, subsidiaries or affiliates (each as defined by the Companies Act and the Regulation on Terminology, Forms, and Preparation Methods of Financial Statements, etc.; the same shall apply hereinafter) of an IC Card Handling Business set forth in Item1, as well as the subsidiaries or affiliates of the parent company of the IC Card Handling Business set forth in Item 1.
(Conclusion of Contract)
Article 4
A contractual agreement regarding use of TOURIST PASMO will be established between user and the Company when the Company issues TOURIST PASMO to the user.
(Method of Use and Restrictions)
Article 5
TOURIST PASMO must be used with equipment capable of processing transactions using TOURIST PASMO (hereinafter, “Specified Devices”) at IC Card Handling Businesses or PASMO Member Stores.
- Notwithstanding the preceding paragraph, TOURIST PASMO cannot be used with Specified Devices in the event described in any of the following items.
- (1) When TOURIST PASMO has been damaged.
- (2) When the contents of the TOURIST PASMO cannot be read due to failure of Specified Devices, natural disaster or other similar causes.
- TOURIST PASMO or Value that has been forged, altered or illegitimately created cannot be used.
(User Agreement)
Article 6
The user agrees to these Rules and the provisions established thereunder.
(Places Accommodating Use)
Article 7
TOURIST PASMO is handled by the Company, IC Card Handling Businesses and PASMO Member Stores.
(Limitations and Termination)
Article 8
The Company may restrict or suspend the handling of TOURIST PASMO at IC Card Handling Businesses and PASMO Member Stores under any of the conditions described in the following items.
- (1) When the Company determines that handling of TOURIST PASMO is not feasible due to situations such as natural disaster, power outage, trouble with the communication equipment of telecommunication carriers, or malfunction of computer systems
- (2) When the Company determines that it is necessary to stop handling of TOURIST PASMO due to unavoidable circumstances, such as maintenance of computer systems
- The Company shall bear no liability for any restriction or suspension of services based on this Article.
(Ownership of TOURIST PASMO)
Article 9
The Company retains right of ownership of TOURIST PASMO.
- In case the situation described in Article 16 applies to the user, the user must return TOURIST PASMO to the Company.
- The user must return the relevant TOURIST PASMO to the Company when the Company deems it necessary due to reasons such as the loss of validity set forth in Article 10, paragraph 1 or a request for a refund of remaining Value on TOURIST PASMO pursuant to Article 17, paragraph 2.
(Invalidation of TOURIST PASMO)
Article 10
TOURIST PASMO shall expire at the end of Expiration Date set forth in Article 14, paragraph 1.
- In the event that TOURIST PASMO loses validity pursuant to the preceding paragraph,, the user may not request the refund of any remaining Value.
Chapter 2 Sale of TOURIST PASMO
(Sale of TOURIST PASMO)
Article 11
When Foreign Visitors to Japan applies to purchase TOURIST PASMO, the Company or the IC Card Handling Business will sell TOURIST PASMO to the Foreign visitors to JAPAN.
- When Foreign visitors to Japan applies to purchase Child TOURIST PASMO, the Company or IC Card Handling Business will sell Child TOURIST PASMO, which can be used until March 31 of the fiscal year in which the child reaches 12 years of age, only upon presentation by the Foreign Visitors to JAPAN of his or her passport or other public identification document separately prescribed by the Company and upon verification that the person is a child.
- Except as otherwise determined by the Company, TOURIST PASMO sold in accordance with the preceding paragraphs shall include Value at the time of sale by the Company or IC Card Handling Business; provided, however, the Value shall not exceed 20,000 yen.
(Top Up)
Article 12
TOURIST PASMO can be topped up with Specified Devices.
- Except as otherwise determined by the Company, TOURIST PASMO will be topped up in monetary increments of 1,000 yen. However, Value of the balance on an individual card may not exceed 20,000 yen.
- Notwithstanding the preceding paragraphs, TOURIST PASMO cannot be topped up using Value contained on another IC card.
(Confirmation of Balance)
Article 13
Value of the balance remaining on a TOURIST PASMO can be confirmed at Specified Devices.
- A history of transactions and monetary balances can be displayed or printed for the last 20 transactions on Specified Devices.
- Notwithstanding the preceding paragraph, display or printing of the transaction history is not possible in any of the following cases;
- (1) When exit processing for the TOURIST PASMO has not been completed.
- (2) When TOURIST PASMO has not been properly processed by Specified Devices.
Chapter 3 Validity
(Expiration Date)
Article 14
TOURIST PASMO may not be used beyond the 28th day from the date of sale (hereinafter, “Expiration Date”).
- The Expiration Date specified in the preceding paragraph can be confirmed using Specified Devices or Reference Paper described in Article 15.
- Child TOURIST PASMO cannot be used, even within the period set forth in paragraph 1, once March 31 of the fiscal year in which the child reaches 12 years of age has passed.
(Carrying Reference Paper)
Article 15
When using a TOURIST PASMO, the user will carry on the paper (hereinafter, “Reference Paper”) from which the TOURIST PASMO registration information can be confirmed.
- In addition to the provisions of the preceding paragraph, the TOURIST PASMO user will present Reference Paper for inspection upon request of the Company or IC Card Handling Business.
- If the user loses Reference Paper mentioned in the preceding paragraph, the user will promptly present the TOURIST PASMO to the IC Card Handling Business and request the reprinting of Reference Paper.
(Upon Invalidation)
Article 16
TOURIST PASMO will be deemed invalid and confiscated under any of the conditions described in the following items. In such cases, the remaining Value on the TOURIST PASMO will not be refunded.
- (1) If Child TOURIST PASMO purchased under false pretenses regarding the intended user’s qualification to receive the card is used, or if Child TOURIST PASMO is used beyond the expiration date as stipulated in Article 14, paragraph 3.
- (2) If TOURIST PASMO or its Value which has been forged, illegitimately modified, or obtained are used.
- (3) When it is determined that TOURIST PASMO becomes malfunctioning due to the user's willful intent or gross negligence.
- (4) When it is determined that any other illegitimate activity has taken place.
Chapter 4 Damage Refund
(Damage Refund)
Article 17
When TOURIST PASMO cannot be used on Specified Devices because of damage to the card, and the user presents said TOURIST PASMO, the Company will issue a necessary document (hereinafter, “Damaged Card Refund Paper”) that will make it possible to obtain a refund for any remaining Value.
- Upon issuance of Damaged Card Refund Paper mentioned in the preceding paragraph, the user may, providing the conditions in the following items are satisfied, claim for a refund of its remaining Value at any time from the day following the date of issue of Damaged Card Refund Paper until 14 days from the day following Expiration Date.
- (1) The user must present Reference Paper with Damaged Card Refund Paper issued as described in the preceding paragraph.
- (2) The user must present the said TOURIST PASMO.
- Once the damaged TOURIST PASMO refund request has been accepted under Paragraph 1, the user may not cancel it.
- Notwithstanding the provisions of Paragraph 1 and 2, the damage refund will not be made for any reason if any of the following items apply.
- (1) If the number embossed on the back of the card cannot be read.
- (2) In cases where the circumstance described in Article 16, item 3 applies.
(Disclaimers)
Article 18
For matters not provided for in these Rules, the Company will not be liable for any damages, etc., incurred by the user due to use of TOURIST PASMO.
Chapter 5 Remaining Balance
(Remaining Balance)
Article 19
Regardless of whether TOURIST PASMO has passed Expiration Date set forth in paragraphs 1 and 3 of Article 14, the user may not apply for a refund of the remaining Value, even if the TOURIST PASMO is no longer necessary.
Chapter 6 Handling by IC Card Issuers Other Than the Company
(Handling of TOURIST PASMO by IC Card Issuers Other Than the Company)
Article 20
Notwithstanding the provisions of Article 7, TOURIST PASMO is handled on routes operated by IC card issuers and routes recognized by the IC card issuers as stipulated in the following items.
- (1) Hokkaido Railway Company
- (2) East Japan Railway Company
- (3) TOKYO MONORAIL CO., LTD.
- (4) Tokyo Waterfront Area Rapid Transit Inc.
- (5) Central Japan Railway Company
- (6) Nagoya Transportation Development Organization Co., Ltd
- (7) MIC Co., Ltd.
- (8) SURUTTO KANSAI
- (9) West Japan Railway Company
- (10) Fukuoka City Transportation Bureau
- (11) NIMOCA CO., LTD.
- (12) Kyushu Railway Company
- When an IC card issuer other than the Company handles TOURIST PASMO in accordance with the preceding paragraph, transport of passengers using TOURIST PASMO shall be as determined by the relevant IC card issuer.
Chapter 7 Handling of User Information
(Use of Collected Information)
Article 21
User information collected in relation to TOURIST PASMO is shared between the Company, IC Card Handling Businesses and Group Companies.
- The collected information is used for the following purposes:
- (1) Business analysis, market research, research and development, advertising, marketing, making plans for improvement of services and other purposes by the Company, IC Card Handling Businesses and Group Companies.
- (2) Provision of the collected data
Chapter 8 Miscellaneous
(Governing Law)
Article 22
These rules shall be governed by the laws of Japan.
(Jurisdiction)
Article 23
Regarding the resolution of any issues arising between the Company and the user regarding TOURIST PASMO, the Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction of the first instance with respect thereto.
Supplementary Provisions
The Japanese text is the original and official version of these rules. In the event of any conflict or inconsistency between the Japanese and English versions, the Japanese version shall prevail.
